Yes, you can donate a failed-smog car in Florida

Failed emissions in Florida? You can still donate. Palm Motor Legacy accepts vehicles that fail smog tests in any condition, with free pickup and a full tax receipt—no repairs needed, ever.

Your car failed a smog or emissions test in Florida, and now you’re stuck wondering if you have to fix it before you can donate. You don’t. A failed smog or emissions test does NOT disqualify your car from being donated to Palm Motor Legacy, benefiting Heritage for the Blind. We accept vehicles in almost any condition across Florida—from Miami, Hialeah, and Kendall to Orlando, Tampa, Jacksonville, Pensacola, and the Space Coast—whether they pass emissions or not.

Here’s how it really works in Florida: when you donate, you’re making a charitable gift and transferring title to a nonprofit, not selling the car in a private sale. The smog and emissions requirements that usually apply between private buyers and sellers typically do not apply to this kind of charitable transfer. You do NOT need to spend money chasing repair codes, replacing catalytic converters, or trying to get the check engine light off just to donate. Palm Motor Legacy arranges towing, then the vehicle is sold as-is at auction or to a buyer who chooses to repair it. You get free pickup, no repair bills, and a tax receipt, and Heritage for the Blind receives funds to support people who are blind or visually impaired.

How to get your free pickup scheduled

1

1. Tell us about your failed-smog vehicle

Start online or by phone and share the basics: year, make, model, mileage, and that it failed a smog or emissions test. Whether you’re in Miami-Dade, Broward, Orlando, Jacksonville, Tampa Bay, or the Panhandle, we’ll confirm it’s eligible—emissions failure and all.

2

2. Schedule your free Florida pickup

Pick a day and time that works for you. We arrange free towing anywhere in Florida, from dense neighborhoods like Little Havana or Downtown Orlando to more rural areas in Polk or Marion County. The tow driver knows the car has emissions issues and takes it as-is.

3

3. Sign the title and hand over the keys

At pickup, you sign your Florida title to Palm Motor Legacy. Because this is a charitable donation, you’re transferring ownership, not making a smog-certified sale. No emissions certificate is required from you. The driver will guide you if you’re unsure where to sign.

4

4. We handle towing, sale, and repairs (if any)

Your car is transported to auction or a qualified buyer who decides whether to repair the emissions problem. You don’t pay for diagnostics, parts, or repairs. The vehicle is sold as-is, and the proceeds support Heritage for the Blind’s services for people with visual impairments.

5

5. Receive your donation tax receipt

After the vehicle is sold, we mail you a tax receipt. Most donors receive at least a $500 receipt; for amounts over $500, we’ll issue the IRS Form 1098-C details you need. You can consult your tax professional to see how to claim your deduction on your federal return.

6

6. Enjoy a clean break from a problem car

Your failed-emissions vehicle is out of your driveway, you didn’t pour money into repairs, and it’s helping a Florida-based effort that benefits Heritage for the Blind. No haggling, no smog re-tests, no dealing with private buyers—just a simple, complete handoff.

Potential complications to watch for

Your name must match the Florida title

Tip: To donate, you must be the legal owner shown on the Florida title, even if the car failed emissions. If your name changed or there are multiple owners listed, have any required co-owners available to sign at pickup so the transfer isn’t delayed.

Don’t remove key emissions parts before donation

Tip: It’s fine if your vehicle failed a smog test, but don’t strip off major emissions components like the catalytic converter or exhaust system after you schedule pickup. The car can be rough, but missing major parts can affect processing and eventual sale.

Know where your title is before you schedule

Tip: We can usually still help if you’ve misplaced your Florida title, but it may slow things down. If possible, locate your title before scheduling. If it’s lost, we can explain how to request a duplicate from the Florida Department of Highway Safety and Motor Vehicles.

Be honest about non-running or hard-to-tow locations

Tip: If the car won’t start, is missing wheels, or is tucked into a tight garage in places like South Beach, Ybor City, or downtown Jacksonville, tell us up front. We’ll dispatch the right kind of tow truck so your free pickup stays fast and hassle-free.

FAQ

My car failed a smog/emissions test. Can I really still donate it in Florida?
Yes. A failed smog or emissions test does NOT disqualify your car from donation to Palm Motor Legacy. Because this is a charitable donation—not a private sale—the usual smog rules between buyer and seller typically don’t apply. We accept vehicles in almost any condition statewide, including emissions failures.
Do I need to fix the emissions problem before I donate?
No. You should NOT spend money on repairs just to donate. We accept vehicles as-is, including those that failed emissions or have a check engine light on. The car will be towed at no cost to you, then sold as-is at auction or to a buyer who may choose to repair it.
Will Florida’s emissions or inspection rules keep you from taking my car?
In a private sale, certain emissions or inspection rules can matter between buyer and seller. A charitable donation is different: it’s a transfer of title to a nonprofit. That means the smog and emissions requirements that apply to private sales generally do not block your donation to Palm Motor Legacy.
Can you pick up my failed-smog car if it doesn’t run?
Yes. Non-running cars are fine, including ones that won’t pass emissions and can’t be driven to a shop. We arrange free towing from your home, workplace, or repair shop anywhere in Florida—from Miami and Fort Lauderdale to Tallahassee, Gainesville, and Fort Myers—at no cost to you.
What happens to my car that failed emissions after I donate?
We have it towed, then it’s sold as-is at auction or to a buyer who understands it has emissions issues. They decide whether to repair it. The sale proceeds support Heritage for the Blind’s programs for people who are blind or visually impaired, and you receive a tax receipt for your donation.
What kind of tax receipt will I get for an emissions-failed car?
After your vehicle is sold, we mail you a receipt reflecting the donation. Many donors receive a $500 or higher receipt. For donations over $500, the sale details are provided using the information needed for IRS Form 1098-C. You can talk with your tax advisor about how to claim your deduction.
I’m in a condo or tight parking area in Florida. Can you still tow it?
Usually, yes. We regularly pick up vehicles from condos and apartments in places like Brickell, Sunny Isles, Downtown Tampa, and Orlando’s urban neighborhoods. Just describe the parking layout when you schedule so we can send the right truck and coordinate with you for access and timing.
